PLEASE READ CAREFULLY: These Terms and Conditions form a legally binding agreement between you and Pennsylvania Marijuana Cards. By using our website or scheduling any service through it, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please stop using this website immediately.
1. Agreement to Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and Pennsylvania Marijuana Cards (“we,” “us,” or “our”), the operator of pennsylvaniamarijuanacards.com (“Website”). These Terms govern every interaction you have with us — including browsing our Website, consuming its educational content, and scheduling telehealth consultations with independent licensed Pennsylvania physicians.
These Terms must be read alongside our Privacy Policy, Consent to Telehealth, and Medical Disclaimer, all of which are incorporated by reference and together form the complete agreement governing your relationship with us. If there is any conflict between documents, these Terms take precedence unless otherwise stated.
You must be at least 18 years of age — or the parent or legal guardian of a qualifying minor patient — to use our services. By accessing this Website, you represent and warrant that you meet this requirement and that you are a legal resident of the Commonwealth of Pennsylvania.
2. Description of Services
Pennsylvania Marijuana Cards operates as a patient education and physician referral platform. We help eligible Pennsylvania residents understand the state’s medical marijuana program and connect them with licensed physicians for telehealth evaluations. Specifically, we provide:
- Educational content about the Pennsylvania Medical Marijuana Program, administered by the Pennsylvania Department of Health (DOH) under the Medical Marijuana Act (Act 16 of 2016)
- Information about the 24 qualifying Serious Medical Conditions (SMCs) recognized by the Pennsylvania Office of Medical Marijuana
- An online scheduling system that connects patients with independent licensed Pennsylvania physicians for telehealth certification evaluations
- Guidance on the patient registration process through the Pennsylvania Medical Marijuana Program Registry
- General information about purchasing medical marijuana from state-licensed dispensaries after receiving a valid patient ID card
IMPORTANT: We are not a medical practice, clinic, or licensed dispensary. We do not provide medical advice, diagnose conditions, or prescribe treatment of any kind. The physicians who evaluate patients through our platform are independent licensed professionals — they are not our employees or agents. We cannot guarantee that any patient will receive a physician certification or ultimately qualify for a Pennsylvania medical marijuana card.
3. The Pennsylvania Medical Marijuana Program — An Overview
Pennsylvania legalized medical cannabis when Governor Tom Wolf signed Senate Bill 3, Act 16 of 2016, into law on April 17, 2016. The program is overseen by the Pennsylvania Department of Health (DOH) through its Office of Medical Marijuana, and program regulations are codified under 28 Pa. Code Chapters 1141 through 1230.
To qualify for a Pennsylvania medical marijuana card, a patient must: (1) be a legal resident of Pennsylvania with a valid Pennsylvania driver’s license or state-issued ID; and (2) receive a certification from a physician registered with the DOH confirming the presence of at least one of the program’s 24 recognized Serious Medical Conditions. The state registration fee for a patient ID card is currently $50, paid directly to the DOH. Patients enrolled in Medicaid, CHIP, SNAP, WIC, or PACE/PACENET programs may be eligible for a state fee waiver — see the PA Medical Marijuana Assistance Program (MMAP) for details.
A medical marijuana card and physician certification are each valid for one year and must be renewed annually. Certified patients may purchase up to a 30-day supply of medical marijuana from any licensed Pennsylvania dispensary. Recreational cannabis remains illegal in Pennsylvania as of the date of these Terms — possession without a valid medical card is a criminal offense under Pennsylvania state law.
Note that while Pennsylvania law provides protections for registered patients from state criminal prosecution, marijuana remains a Schedule I controlled substance under federal law. Holding a Pennsylvania medical marijuana card does not shield patients from federal enforcement action.
4. Qualifying Serious Medical Conditions
The Pennsylvania Department of Health currently recognizes 24 Serious Medical Conditions (SMCs) that may qualify a patient for the state’s medical marijuana program. These include, but are not limited to:
- ALS (Amyotrophic Lateral Sclerosis)
- Anxiety Disorders
- Autism Spectrum Disorder
- Cancer
- Chronic Hepatitis C
- Crohn’s Disease
- Damage to the nervous tissue of the central nervous system (brain-spinal cord) with intractable spasticity and associated neuropathies
- Dyskinetic and Spastic Movement Disorders
- Epilepsy
- Glaucoma
- HIV/AIDS
- Huntington’s Disease
- Inflammatory Bowel Disease (IBD)
- Multiple Sclerosis (MS)
- Neurodegenerative Diseases
- Neuropathies
- Opioid Use Disorder (where conventional treatments are ineffective or contraindicated)
- Parkinson’s Disease
- Post-Traumatic Stress Disorder (PTSD)
- Severe Chronic or Intractable Pain
- Sickle Cell Anemia
- Terminal Illness
- Tourette Syndrome
For the complete and current official list, always refer directly to the Pennsylvania Department of Health’s Medical Marijuana Program page. This list is periodically reviewed by the Medical Marijuana Advisory Board, which accepts petitions to add new qualifying conditions.
Only a physician registered with the Pennsylvania DOH may certify a patient for medical marijuana. A physician’s certification does not guarantee issuance of a state medical marijuana ID card — final approval rests with the Pennsylvania Department of Health.
5. No Medical Advice — Important Limitation
Nothing on this Website — including condition summaries, eligibility information, FAQ content, blog articles, or any other material — constitutes medical advice, diagnosis, or treatment. All content is provided for general educational purposes only and is not a substitute for a consultation with a qualified, licensed healthcare professional.
Do not make decisions about your health or any medical condition based solely on information you read here. Always consult a licensed physician about your specific circumstances. Do not delay or disregard professional medical advice because of something you read on this Website.
EMERGENCY NOTICE: If you are experiencing a medical emergency, call 911 immediately or go to your nearest emergency room. This Website is not for emergency medical situations. Do not contact us for emergency help of any kind.
6. Heally Affiliate Partnership — Disclosure
We partner with Heally Inc. (getheally.com) as an affiliate and referral partner. When you schedule a consultation through our Website, you are connected with the Heally telehealth platform to complete your appointment. Heally is an independent company operating under its own Terms of Service and Privacy Policy, which we encourage you to review at getheally.com before completing your booking.
We receive affiliate compensation when a patient completes a booking through our referral link. We are disclosing this relationship in full compliance with FTC Endorsement Guidelines (16 CFR Part 255). This financial relationship has no influence whatsoever on the independent clinical judgment of any physician. Physicians certify patients based solely on medical history and applicable Pennsylvania DOH guidelines — never on our commercial relationship with Heally.
7. About the Certifying Physicians
Telehealth evaluations available through our platform are conducted by independent physicians who are licensed to practice medicine in the Commonwealth of Pennsylvania and are registered with the Pennsylvania Department of Health’s Medical Marijuana Program. All participating physicians have completed the mandatory DOH-required training to participate in the medical marijuana certification program, as mandated under Act 16 of 2016.
Verifying Your Physician
You can verify whether a physician is registered to participate in the Pennsylvania medical marijuana program using the Find a Practitioner tool on the Pennsylvania Department of Health website. Your physician’s Pennsylvania medical license number and National Provider Identifier (NPI) will be made available to you prior to your consultation.
Physician Independence
All certifying physicians through our platform practice as independent medical professionals. They are not employees, agents, or representatives of Pennsylvania Marijuana Cards. Their clinical decisions are entirely their own, made in accordance with their professional medical judgment and Pennsylvania DOH regulations. We have no authority to direct, influence, or override any physician’s clinical determination about whether to certify a patient.
8. Fees, Payment, and Refund Policy
Consultation Fees
Our current fee for a new patient physician evaluation is $159. The fee for an annual renewal evaluation is $149. These fees cover our scheduling and facilitation services only.
The Pennsylvania state registration fee for a patient ID card is $50, paid separately and directly to the Pennsylvania Department of Health. This state fee is not included in our consultation fee and is outside our refund policy. Patients enrolled in Medicaid, CHIP, SNAP, WIC, or PACE/PACENET may qualify for a state fee waiver through the DOH Medical Marijuana Assistance Program (MMAP).
Payment
Payment is collected at the time of booking through our secure, PCI-DSS compliant third-party payment processor. We accept all major credit and debit cards. We do not store your payment card information on our own servers.
Money-Back Guarantee
We offer a full refund of our consultation fee if the evaluating physician determines you do not qualify for a medical marijuana certification under Pennsylvania law. No runaround, no excessive paperwork — just a straightforward refund process.
To request a refund, email us at [email protected] within 14 days of your appointment with the subject line “Refund Request,” along with your name and appointment date. Approved refunds are processed within 7 to 14 business days.
When the Guarantee Does Not Apply
- You did not attend your scheduled appointment and failed to provide at least 24 hours’ advance notice of cancellation
- You provided false, misleading, or fabricated information during the registration or evaluation process
- You have previously received a refund from us for a prior consultation
- The Pennsylvania DOH denies your application after a physician has already issued a valid certification — this outcome is governed entirely by DOH policy and is beyond our control
9. Your Responsibilities and Prohibited Uses
By using our Website and services, you agree to the following:
- You will provide accurate, complete, and truthful information in all forms, intake processes, and during your physician consultation
- You are 18 years of age or older, or you are the verified parent or legal guardian of a qualifying minor patient
- You are a legal resident of the Commonwealth of Pennsylvania with a valid Pennsylvania driver’s license or state-issued ID
- You will use our services only for the lawful purpose of seeking a Pennsylvania medical marijuana certification
- You will not misrepresent or fabricate any medical condition or symptom history
- You will not attempt to use our services if you are not a Pennsylvania resident or do not otherwise meet program eligibility requirements
- You will not use automated tools, bots, web scrapers, or any software to access or extract content from this Website without our written permission
- You will not attempt to interfere with, disrupt, or compromise the security or functionality of our Website or underlying systems
Violation of any of these responsibilities may result in immediate termination of your access to our services, cancellation of any pending appointment without a refund, and — where applicable — reporting to relevant legal and regulatory authorities.
10. Federal Law Notice
Marijuana remains classified as a Schedule I controlled substance under the federal Controlled Substances Act (21 U.S.C. § 812). Pennsylvania’s Medical Marijuana Act provides legal protections from Pennsylvania state criminal prosecution only. It provides no protection from federal law enforcement action.
Under federal law, individuals who use or possess marijuana — including medical marijuana — are generally prohibited from purchasing or possessing firearms or ammunition. Holding a Pennsylvania medical marijuana card may also affect your eligibility for certain federal employment positions, security clearances, professional licenses, and federally assisted housing programs. We strongly encourage you to consult a licensed Pennsylvania attorney if any of these areas are relevant to your situation.
11. Intellectual Property

You may view and print content for personal, non-commercial use only.
You may not copy, reproduce, redistribute, publish, display, modify, or create derivative works from any content on this Website without our prior written consent. 13. Disclaimer of Warranties
The Website and all content, information, and services provided through it are offered on an “as is” and “as available” basis, without warranties of any kind. Pennsylvania Marijuana Cards expressly disclaims all warranties — whether express, implied, or statutory — including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Website will be available at all times, free from errors, free from technical defects, or free from viruses or harmful components. We make no representation that any information on this Website is complete, current, or suitable for your specific circumstances.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Pennsylvania Marijuana Cards and its officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — this Website or our services. This includes, without limitation, loss of data, loss of revenue, loss of goodwill, or personal harm, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising from your use of our services shall not exceed the total amount you paid us in connection with the specific service giving rise to the claim.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable Pennsylvania or federal law.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any dispute arising from or related to these Terms or your use of this Website shall first be addressed through good-faith written negotiation between both parties.
If direct negotiation does not resolve the matter within 30 days of written notice, both parties agree to resolve the dispute through binding arbitration under the rules of the American Arbitration Association, with proceedings held in Pennsylvania. Judgment on any arbitration award may be entered in any court of competent jurisdiction.
By using this Website, you waive any right to participate in a class action lawsuit or class-wide arbitration against Pennsylvania Marijuana Cards. This class action waiver is a material condition of your use of our services.
Nothing in these Terms prevents you from filing a complaint with the Pennsylvania Office of Attorney General, Bureau of Consumer Protection, the Pennsylvania State Board of Medicine regarding a physician’s professional conduct, or the Pennsylvania Department of Health regarding program compliance matters.
16. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we do, we will revise the “Last Updated” date at the top of this page. For material changes that substantially affect your rights or obligations, we will provide additional notice — such as a prominent on-site banner or an email to registered users where applicable.
Your continued use of this Website after revised Terms have been posted constitutes your acceptance of those changes. If you do not agree with any changes, please stop using the Website and services immediately.
17. Severability
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and all remaining provisions will continue in full force and effect. The invalidity of one provision does not affect the validity of the remainder of these Terms.
18. Entire Agreement
These Terms, together with our Privacy Policy, Consent to Telehealth, and Medical Disclaimer, constitute the entire agreement between you and Pennsylvania Marijuana Cards regarding your use of this Website and our services. They supersede all prior agreements, representations, or understandings — whether oral or written — relating to the same subject matter.
